The Centers for Disease Control and Prevention (CDC) has authorized the use of a three vaccines against the SARS CoV-2 virus (COVID-19).
Currently, none of the three available COVID-19 vaccines qualify for a vaccine injury claim under the National Vaccine Injury Compensation Program (VICP). The VICP provides vaccine injury compensation to individuals who file a petition and are found to have been injured by specific vaccines. The COVID-19 vaccines are excluded in part because COVID-19 is currently classified as a global pandemic and none of the vaccines used to prevent it are recommended for routine administration in children.
Because COVID-19 is currently classified as a pandemic, anyone injured by a COVID-19 vaccine may be able to seek compensation through the Countermeasures Injury Compensation Program (CICP). Information about the CICP can be found here. Unfortunately, the CICP is an administrative program that does not have provisions for legal representation. This fact sheet can help guide you through the process. The benefits request form can be found here.
Please note that you have one (1) year from the date of vaccine administration to file for vaccine injury compensation in the CICP. You can also get information on filing for these benefits here.
If you are experiencing a negative reaction to a COVID-19 vaccine, we recommend that you consult your primary care physician and thoroughly document any reaction, tests and/or treatments provided.
